Online Notary Public - (this allows for an online notary public to notarize a document remotely, without the principal(s) being in the online notary public's physical presence)
An Executive Order has been signed by the Governor allowing for the early implementation of the Online Notary Public Act. In addition, emergency regulations related to the Act have been approved. Please see General Information below for additional details.
Via Executive Order, the delayed operative date of July 1, 2020 is waived for the Online Notary Public Act allowing early implementation of the Act.
These regulations are only in effect through June 30, 2020, at which time the Online Notary Public Act becomes operative by its own terms and the emergency regulations will be replaced with codified regulations. The emergency regulations lift some of the requirements through the emergency period to allow for expedited processing, such as the requirement for the online notary public applicant and solution provider to take the course of instruction prior to being approved; but still requires the online notary public and solution provider to take the course within 30 days of being notified by the Secretary of State that the course is available. The Secretary of State is also allowing for applications and tests to be submitted without being notarized during this emergency period. During the emergency period the solution provider only has to give a demonstration of their technology if requested by the Secretary of State and can use the online notary public's registration certificate for verification of their authorization to perform online notarial acts.
Online Notary Registration
To become an online notary public, please submit a completed Online Notary Registration Form and a completed Online Notary Public Test (both forms available in the below links) along with the required $50 fee to the Secretary of State's Office. You must already be a Nebraska notary public to become an online notary public. The Online Notary Registration Form requires you identify an online notary solution provider approved by the Secretary of State (please see approved solution providers identified below on this page). Once your registration is approved and processed, you will receive your online notary commission certificate via email. Once you receive your online notary commission certificate you will need to provide it to your approved solution provider. For questions please email firstname.lastname@example.org.
