New UCC/EFS System Frequently Asked Questions

The Secretary of State, through the Business Services Division, is the government office that files and maintains, for public record, financing statements related to security interests in personal property, including Uniform Commercial Code (UCC) records, Effective Financing Statements (EFS), state and federal tax liens, and statutory agricultural liens

We expect the system to go live in the Fall of 2025. During the time of conversion, our systems will be down for a short period of time as we transition to the new system. We will provide notice of the anticipated downtime when the schedule is finalized.

Based upon feedback from filers, we have several new features that will be available.

  • Certified UCC/EFS Searches - When conducting a UCC or EFS debtor name search, you will now have the option to obtain a certified search online. Previously, this was only available by mail/in person with our office.  
     
  • Lien Document Search – You will be able to search and find a filed document by the  subsequent filing number, such as the continuation or amendment number. 
     
  • EFS Amendments – You will have the ability to file an EFS amendment online. Previously, this was only available by mail/in person with our office.
     
  • Collateral Uploads – Currently online filings only allow the typed entry of collateral when filing. The new system will continuate to allow this feature, but in addition, the new system will allow the ability to upload collateral electronically as a PDF document. Note: At this time, uploads will be reviewed by the Secretary of States office prior to being accepted for personally identifiable information such as social security numbers. This will affect the date and time the filing will become effective in the system. 
     
  • UCC-3 Amendment – Multiple Actions – Currently our office only allows 1 action per UCC3 amendment form. The new system will allow you to file selected multiple changes on one amendment form (e.g. a continuation and a debtor change). You will only be charged one filing fee for the amendment, even if there are multiple changes being selected. 
     
  • Access to Recent Filing History - The system provides online access to the status, filed copies, and receipts for documents recently submitted online through the "My Work Queue" portal. 

No, the $100 yearly subscription with Nebraska.gov (Tyler Technology) will no longer be required to file UCC/EFS documents online with our office. The new online filing system will require an account to be created.

We will no longer be billing monthly for online UCC/EFS filings. Filing fees will be paid at time of submission using either a credit card, ACH or frequent payor account.
