FAQ for Online UCC Financing Statement Amendment Filings

This guidance document is advisory in nature but is binding on an agency until amended by such agency. The online filing service for UCC Amendments allows you to file a Form UCC3 electronically. Simple data entry is required and the filing document is created for you. Sample UCC3 forms are available on the Secretary of State website at this link and within the online filing service, look for the blue  sample ucc3 formbutton at the top of the filing screen.

 

Q: What amendments can I file?

A: You can file amendments to – 

  • Add debtors
  • Change existing debtors’ information
  • Delete a debtor
  • Add secured parties
  • Change existing secured parties’
    information
  • Delete a secured party
  • Add Collateral
  • Restate Collateral
  • Delete Collateral

You can also file an Assignment, a Continuation or a Termination.

 

Q:  Can I file multiple amendments together?

A:  Multiple types of amendments cannot be filed together.  However, if you are performing an amendment to add or change debtors, you can add or change as many debtors as you need to in a single filing.  The same applies for adding or changing secured parties.

 

Q:  What is the Optional Filing Information screen?

A:  The first 4 fields give you the ability to enter information that will appear on the filed image of the document.  Name of Filer, Filer Phone Number and Email Contact at Filer entries will display in sections A and B of the generated filing image of your UCC Financing Statement Amendment.  An entry in the field for Optional Filer Reference Data will appear on line #10 of the generated filing image.  The Client Memo field is provided for you to enter a reference for your billing purposes.  Anything entered in Client Memo will appear on your itemized invoice through Nebraska.gov.

 

Q:  What is the Financing Statement Amendment Addendum screen?

A:  If you need to supplement your filing with information contained on a form UCC3Ad, you can check the box for ‘I need to file a form(s) UCC3Ad as an attachment to my UCC financing statement amendment.’ and fill in appropriate fields.   A sample form and instructions are available to view on this screen.  Look for the blueSample UCC3ad form with Instructionsbutton at the top of the screen.
If you do not need this form, do not check the box and select the Continue button to advance to the final review page for your filing.

 

Q:  Who should I call with filing questions?

A:  If you need assistance determining what information needs to be included with your filing you will need to contact your legal advisor.  Neither the Nebraska Secretary of State UCC Division nor Nebraska.gov can give advice on how to file.  If you are receiving an error, or having trouble submitting your filing, Nebraska.gov can offer technical assistance.  If you have a question related to the original financing statement you are trying to amend you can contact the UCC Division.

 

Q:  When will the image of my filing be available?

A:  The record of your filing is immediately available for you to see using the Secretary of State online UCC Document number search https://www.nebraska.gov/sos/ucc/uccdoc.html however generated document images may not be available for up to 48 hours after filing.
